Fan ejected for getting up to pee during 'god bless america' - sleepyhead - 04-15-2009

I posted about this on the old board, but the law suit is official now. My friend Brad (incidentally a Red Sox, not a Yankee fan) was ejected from a Yankees/Red Sox game last year because he left his seat to pee during 'God Bless America'. Apparently the Yanks instituted a policy that you couldn't leave your seat during the 7th inning stretch and that chains would be put up. Anyway his law suit with the NYCLU/ACLU is official now and it's getting a lot of coverage. He isn't suing for any money, just for the precedent of it all. There was a blurb on the Score about it and I called in to give a little more info. They asked me to have him contact them as they want to interview him. It will be really interesting to see how this all plays out.

Me on the Score, 25 min in (I said "America the Beautiful", but it was "God Bless America"):

I remember hearing about that, but I didn't realize he was your buddy. I also must have slept through your call, as I woke up on the train and Boers and Bernstien were still discussing it.

Even if this was an intentional protest, this is free speech. Good luck to your buddy, as this is bull shit.

Freedom of speech? I think Freedom to Piss sounds more fitting in this case

If the policy was in place before he bought his ticket, I'm not sure I see the suit.

I'm not saying it's not a stupid, bs policy, though.

What did he think of how the Colbert Report handled it? I thought it was hilarious myself.

He's obviously fighting the policy. It's completely unconstitutional. "thou shall not leave thy seat during god bless america". You can't fucking do that.

And no, he's not black.

From the NYCLU article

“The role of police officers is to enforce the law,” NYCLU Executive Director Donna Lieberman said. “New York’s finest have no business arresting someone for trying to go to the bathroom at a politically incorrect moment. That is an abuse of authority and a violation of the constitutional principles that our country is founded on.”

The lawsuit asserts that Campeau-Laurion’s constitutional rights were violated under the First, Fourth and Fourteenth amendments. Defendants are NYPD Commissioner Raymond Kelly, the NYPD, the New York Yankees Partnership, the City of New York and the two police officers who participated in Campeau-Laurion’s ejection.

Oi, I thought it was an usher who stopped him for some reason.

Nonetheless, I don't see how they're gonna make it a first amendment deal. Fourth (and by continuation, 14th), I can see, I suppose.
